These Terms & Conditions ("Terms") apply to your use of whiteeaglefoodsnj.com (the "Site") and to orders placed with White Eagle Foods NJ ("we," "us," or "our") in store, by phone, by email, or inquiries received through the Site. By using the Site or placing an order, you agree to these Terms.
Use of the Site
You may use the Site for personal, lawful purposes. You agree not to misuse the Site, interfere with how it works, or try to access it in ways we didn't intend. We may update, change, or take down any part of the Site at any time.
Menu, Pricing, and Availability
Our products are handmade in small batches, so varieties, seasonal items, and quantities change often. Menus, prices, photos, and descriptions on the Site are provided for convenience and may not reflect what is currently in store. Prices and availability are subject to change without notice, and we may limit quantities. If we make an error in pricing or a description, we may correct it and will contact you before filling an affected order.
Orders and Pickup
Unless delivery is explicitly arranged, orders are for pickup at our store during business hours. Please pick up orders at the agreed time. Perishable items not picked up within 24 hours of the scheduled pickup time may be released, and prepaid amounts may not be refunded.
Catering and Large Orders
Catering and large orders are confirmed only after we accept them in writing (including by email) and any required deposit is paid.
• Lead time: Please contact us at least 10 days before your event. We'll do our best with shorter notice but can't guarantee it.
• Deposits and payment: [A deposit of 50% is due to confirm your order. The balance is due at pickup or delivery.]
• Changes: Changes to items or guest count must be made at least 5 days before your event.
• Cancellations: Orders cancelled at least 5 days before your event receive a full refund of the deposit. Later cancellations may not be refunded, since ingredients are purchased and food is prepared ahead.
• Delivery and setup: Delivery and setup are available for an additional fee and depend on location and availability. Someone must be present to receive the order at the agreed time.
Fundraising
Fundraisers are arranged through a separate agreement with the participating organization, which sets the order deadline, delivery date, and proceeds. The participating organization is responsible for distributing orders to its members after delivery.
Food safety, Handling, and Reheating
Most of our products, including pierogi, golabki, and smoked kielbasa, are fully cooked and only need reheating. Fresh (biala) kielbasa is raw and must be fully cooked to a safe internal temperature before eating. Frozen items should be kept frozen until use, and all perishable items should be refrigerated promptly. Once food leaves our store, or is delivered to you, we are not responsible for how it is stored, transported, reheated, or served. Cooking and reheating suggestions on the Site are general guidance only.
Allergens and Dietary Needs
Our kitchen handles wheat, milk, eggs, pork, beef, and other common allergens, and our products are made with shared equipment. We cannot guarantee any item is free from allergens or cross-contact. If you or your guests have a food allergy or dietary restriction, please ask us about ingredients before ordering and use your own judgment.
Refunds and quality concerns
Because our products are perishable, all sales are final once an order leaves our store. If something isn't right with your order, please contact us within [24 hours] of pickup or delivery, and we'll work with you to make it right.
Intellectual Property
The White Eagle Foods NJ name, logo, recipes, photos, text, and other content on the Site belong to White Eagle Foods NJ and/or its licensors. You may not copy, reproduce, or use them without our written permission.
Reviews and Third-Party Links
The Site may link to or display content from third-party sites, such as Yelp, Google Maps, and social media. We don't control those sites and aren't responsible for their content or practices. Customer reviews reflect the opinions of the people who wrote them.
Disclaimer
The Site and its content are provided "as is" and "as available." To the extent permitted by law, we make no warranties, express or implied, about the Site, including that it will be error-free or always available.
Limitation of Liability
To the fullest extent permitted by law, White Eagle Foods NJ will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our products. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Some states do not allow certain limitations of liability, so some of these limits may not apply to you. Nothing in these Terms limits any rights you have under applicable law that cannot be waived.
Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Burlington County, New Jersey.
Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date will show when they were last revised. Orders already confirmed will follow the Terms in place when they were confirmed.
